General terms and conditions of sale

1.0 Scope of Application
The following General Terms and Conditions of Sale (GTC) apply without restriction to all products offered and legal transactions concluded on the website www.sylvac.ch on behalf of:

By accepting the general terms and conditions of sale, the customer, whether an individual or a legal entity, declares that they have read and unconditionally accept the general terms and conditions of sale for each order placed on our website sylvac.ch / sylvac.com
Any other agreement or commitment by Sylvac SA must be made in writing.
Sylvac SA reserves the right to modify the general terms and conditions of sale (GTC) at any time, and they will be applicable upon publication.
Our online products are deliverable worldwide. In some instances, sale outside of Switzerland can be subject to a specific offer or quotation, including all export-related terms.
Sylvac SA reserves the right to request additional information and guarantees. The buyer undertakes to comply with all restrictions and sanctions related to international trade. Sylvac SA reserves the right to cancel any order without notice if there is doubt about the final destination of the ordered products.

2.0 Products and Prices
Sylvac SA offers a wide range of measuring instruments, accessories and softwares and may expand or reduce the range of products available online at any time.
Product images and other graphics used on the website are for illustration purposes and are not binding.
Prices are in Swiss Francs (CHF), VAT is not included and will be added at the end of the order if applicable, including packaging costs, INCOTERM Ex-Works.
Our prices may change at any time and without notice. Promotional offers have limited validity.
The products and prices published on our online shop are considered offers subject to the resolutive condition of delivery impossibility or incorrect price quotation, either by the manufacturer of partner products or Sylvac SA.
Sylvac SA is not responsible for incorrect prices posted online by mistake and reserves the right to modify and promptly inform the customer via email. The customer may cancel all or part of their order and claim a partial or full refund.
3.0 Order and Contract Conclusion
When the customer places an online order and accepts the general terms and conditions of sale (GTC), they will receive an email confirmation of their order, indicating that the contract is concluded, subject to the resolutive condition of delivery impossibility.
If the product is no longer available, Sylvac SA will inform the customer by email and proceed with the total or partial cancellation or refund of the order. Sylvac SA cannot be held responsible for the impossibility of delivering the ordered product(s).
Upon agreement with the customer, a partial delivery may be made for available products. Shipping fees may be added to the order.
The customer is responsible for providing accurate identification information, such as name, surname, company name, address, and a functional email, when placing the order. The customer agrees to provide any information changes within 7 days that may hinder the delivery process. In case of incorrect information, Sylvac SA reserves the right to block the order.
4.0 Payment Conditions and Methods
The payment methods available are:

• PayPal
5.0 Retention of Title
Products delivered to the customer remain the property of Sylvac SA until full payment of the invoice. The customer authorizes Sylvac SA to register any retention of title in the property register of the customer’s canton of residence.
6.0 Delivery and Shipping Costs
Items in stock are shipped within 2 to 8 working days, conditions EX-WORKS.
7.0 Cancellation of the Sales Contract and Right of Return
Sylvac SA does not grant a right of return upon contract conclusion. With our agreement and in writing, Sylvac SA may grant a return right for goods in perfect condition, in their original packaging, complete, and unused. Return shipping costs and transport risks are borne by the buyer. After 14 days, Sylvac SA may deduct a percentage from the value of returned items.
8.0 Warranty and Refund
The warranty period is two years. The buyer is responsible for verifying the conformity of the delivered goods in terms of quantity and content upon delivery.
Any claims must be made within 3 days of receiving the goods. Any defects covered by the warranty must be reported as soon as possible. Sylvac SA, in agreement with the manufacturer, will proceed with the exchange or repair of the defective item. If the item cannot be repaired or exchanged, Sylvac SA will refund the buyer within 30 days.
The warranty does not cover misuse, non-compliance with the manufacturer’s instructions, natural wear and tear, or damage due to improper storage.
9.0 Liability
Sylvac SA disclaims all liability except in cases of gross negligence for damages and potential compensation claims resulting from delays, delivery impossibility, or other causes, including indirect damages arising from production losses, order losses, and other damages resulting from the contractual transaction.
In the context of measuring instruments, the buyer is responsible for verifying the manufacturer’s technical specifications, such as the accuracy or fidelity of the instrument. The buyer can absolve themselves of this responsibility by requesting Sylvac SA to provide the instrument with an accredited SCS or other organization’s calibration certificate.
Sylvac SA cannot be held responsible for non-compliance in the measurement process resulting from the use of the instrument and its indirect economic consequences.
10.0 Data Protection
All data collected on our website is treated confidentially.
